Mantell Associates is currently partnered with a well-established Biopharmaceutical organisation. They are currently looking to strengthen their team through the appointment of a Corporate Counsel, Commercial and Market Access.
Corporate Counsel, Commercial and Market Access - Responsibilities:
Provide legal advice and support to the contract needs of business units, related business functions such as Sales, Marketing, Market Access, Medical Affairs, Compliance, Regulatory and Procurement
Review and prepare contracts for the legal department, manage support in other jurisdictions, and collaborate with other attorneys within our International Legal team
Provide advice and counsel in the areas of healthcare law, including FDA regulations and anti-kickback, government price reporting, and fraud and abuse
Work closely with market access and commercial teams to support commercial strategies for the sale and distribution of products
Advise on potential legal issues related to customer contracting, pricing and price reporting, including FD&CA and anti-kickback
Draft, negotiate, review, and revise commercial and market access agreements associated with the business, including healthcare professionals, providers, vendors, licensors, consultants and speaker agreements; master services agreements, statements of work, sales, supply, distribution, PBM, GPO, Wholesaler, discount and rebate, distribution vendor and service agreements
Collaborate with other Legal and Compliance colleagues to provide legal support to the organisation and supervise outside counsel as required
Ensure that clients are kept abreast of all relevant legal developments in their areas of business by providing training and periodic updates
Corporate Counsel, Commercial and Market Access - Requirements:
5+ years' minimum of relevant experience in a commercial attorney or similar position for a biotech or pharma company
7+ years' experience with a life sciences company and/or a reputable, highly rated law firm, or a combination of both, with experience related to the pharmaceutical or life-sciences companies
Extensive experience providing legal advice to Commercial Market Access and Commercial Sales teams, including pricing and contracts groups and sales operations teams
Experience with contractual requirements of commercial and government payers, GPOs, pharmacy services, and trade and distribution within the U.S. healthcare industry, as well as those of a pharma sales force
Extensive knowledge of relevant federal and state laws
Experience providing legal advice on promotional materials is helpful but not required
Ability to work effectively in a global work environment
Ability to make decisions, balancing risks versus impact
Ability to work under pressure and cope with multiple priorities
Ability to drive change throughout an organisation, overcoming resistance and barriers
Outstanding communication of information and ideas, both written and verbal, to diverse audiences
